Terms of Service

BuildStack provides AI front-desk services for trades businesses — SMS, email, social, and (where unlocked) voice agents that respond to customer messages on your behalf. We also build websites and provide setup, training, and ongoing tuning.

You remain the operator of your business. Our agents act under your instruction and within the knowledge base we build with you. You are responsible for the accuracy of pricing, service offerings, and any commitments your agents make.

To use BuildStack you must (i) be authorised to bind your business, (ii) provide accurate information about your services, pricing, and service area, and (iii) keep your account credentials confidential. You are responsible for activity under your account.

You must be at least 18 years old. We do not knowingly serve sole traders or businesses outside the UK and US at this time.

BuildStack subscription fees are billed monthly in advance. Setup fees are billed once at the start of onboarding. Website builds are billed as agreed in your build quote. All fees are exclusive of VAT (UK) or applicable US sales tax, which we will add where required.

30-day money-back guarantee.If you cancel within 30 days of go-live and BuildStack hasn't generated a single booked job for you, we refund your most recent monthly subscription fee. The one-time setup fee becomes non-refundable after one week of onboarding because the work to build your knowledge base, tune voice, and warm sending domains is already done.

Late or unpaid invoices may result in suspension of service. Where permitted by law, we may charge interest on overdue invoices at 2% per month or the maximum rate allowed.

No contracts. You can cancel at any time, effective at the end of your current billing period. Cancel by emailing hello@getbuildstack.com or through your account dashboard.

On cancellation, your phone number stays with you, your sending domain stays with you, and your data is yours. We'll export anything you want and delete the rest within 30 days.

You must not use BuildStack to:

• Send unsolicited bulk messages, spam, or any communication prohibited by the TCPA, CAN-SPAM, GDPR, PECR, or equivalent law.
• Mislead customers about your identity, pricing, or services.
• Violate the terms of any underlying messaging carrier or social platform (Twilio, Meta, Google, etc.).
• Reverse-engineer, scrape, or attempt to copy BuildStack's software, prompts, or knowledge base systems.
• Use BuildStack for any illegal or harmful purpose.

We may suspend or terminate accounts that breach these rules, with or without notice depending on severity.

BuildStack's agents are AI systems trained on the knowledge base we build with you. They are not perfect. While we audit transcripts and retune continuously, an agent may occasionally:

• Reply outside its trained scope.
• Misinterpret a customer's request.
• Quote a price that needs your confirmation.

You are responsible for reviewing agent activity, setting escalation thresholds (e.g. always draft on quotes above $X), and honouring or correcting commitments the agent makes. The 30-day guarantee covers go-live results, not perfection.

Our handling of personal data is described in our Privacy Policy. For customers handling EU or UK personal data, a Data Processing Agreement is available on request and is incorporated into these Terms by reference.

BuildStack and its underlying software, prompts, knowledge-base templates, and training systems are owned by us. Content you upload — your pricing, service descriptions, photos, customer messages — remains yours. You grant us a limited licence to use it solely to operate the service for you.

Trade marks, logos, and brand assets remain with their respective owners.

BuildStack is provided "as is". We make no warranty that the service will be uninterrupted, error-free, or that the agents will book every job. We disclaim all implied warranties to the extent permitted by law.

Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law — including, in the UK, liability for death or personal injury caused by negligence, or fraud.

To the maximum extent permitted by law, our total liability arising out of or in connection with these Terms or the service is limited to the fees you paid us in the 12 months preceding the event giving rise to the claim.

We are not liable for indirect, consequential, special, or punitive damages — or for lost profits, lost revenue, or business interruption.

UK customers: these Terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction.

US customers: these Terms are governed by the laws of the State of Georgia, USA, without regard to conflict-of-laws principles. Disputes will be resolved in the state or federal courts located in Fulton County, Georgia.

If any provision is held unenforceable, the rest of the Terms remain in effect.

We may update these Terms from time to time. Material changes will be announced with at least 30 days' notice by email or in-app notification. Continued use of BuildStack after a change takes effect means you accept the new Terms.
